This page (together with the documents referred to on it) tells you the terms and conditions (“Terms and conditions”) on which we supply any of the products and services (“Products”) listed on our Getz Healthcare Hong Kong E-store, and / or on Getz Healthcare Hong Kong mobile app (“Site") to you.
Please read this Agreement carefully before accessing or using this E-Store and its mobile application. By accessing or using this site, you acknowledge that you have read and understand the Terms and Conditions and agree to be bound by all of its provisions. The information and services on this site are provided Getz Healthcare (Hong Kong) Limited and its suppliers, subject to your agreement to the terms and conditions below.

The Site is operated by Getz Healthcare (Hong Kong) Limited and/or our affiliates (Getz Healthcare / we / us / our).
Product Information and Availability
The E-store primarily offers professional items for sale to physicians or dentist or healthcare professionals.
We strive to provide accurate and up-to-date product information, including descriptions, specifications, pricing, and availability. However, we do not warrant the accuracy, completeness, or reliability of any information on the E-store.
All products and services offered on the E-store are subject to availability. We reserve the right to modify, substitute, or discontinue any product at any time without prior notice.
Use of Information and Services
The information (including without limitation advice and recommendations) and services on the site are intended solely as a general educational aid and are neither medical nor health care advice for any individual problem nor a substitute for medical or other professional advice and services from a qualified healthcare provider familiar with your unique facts. Always seek the advice of your physician and / or dentist or other qualified healthcare provider on any questions you may have regarding a medical condition and prior to starting any new treatment. Getz Healthcare assume no responsibility for any consequence relating directly or indirectly to any action or inaction you take based on the information, services or other materials on this site. While Getz Healthcare strives to keep the information on this site accurate, complete, and up-to-date, Getz Healthcare cannot guarantee, and will not be responsible for any damage or loss related to the accuracy, completeness or timeliness of the information.
User Account Registration
By registering through our E-Store, you confirm your acceptance of all the terms and conditions outlined in these Terms. By agreeing to these Terms, you declare and warrant the following:
(a) If you are an individual, or you are at least 18 years old and have the legal authority to enter into these Terms;
(b) If you are representing a corporation / company, your actions are duly authorized by your board of directors or through other legal means specified in the relevant laws or constitutional documents of your company. Furthermore, all purchases made through the E-Store will fall within the scope of your authority to enter into contracts;
(c) If you register as a professional customer and submit an approved dental or medical practitioner license issued by the Hong Kong government, you acknowledge and affirm that you are licensed to utilize, administer, and operate the products and/or equipment that require such a license.
Additionally, you warrant and assure us that:
(a) The information provided during the registration process is true, accurate, current, and complete.
(b) You will promptly update your registration information to maintain its truthfulness, accuracy, currency, and completeness. If we have reasonable grounds to suspect that any information is untrue, inaccurate, not current, or incomplete, we reserve the right to suspend or terminate your registration.
Communications
By creating a User Account, you agree to receive certain communications in connection with us whether via SMS, Email, App Notifications, among others.
Unless you expressly notify us otherwise, you understand and agree to receive promotional messages either by email, SMS or other communication channels from Getz Healthcare, including its subsidiaries, affiliates, partners, agents and assigns, which communication and promotional messages may be based on your location and/or other information.
Limitation of Liability
To the maximum extent permitted by applicable law, Getz Healthcare and its affiliated companies, directors, senior executives, employees, and suppliers shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of products purchased through the E-Store. This includes, but is not limited to, loss of profits, loss of goodwill, loss of use, data loss, or other intangible losses.
Getz Healthcare shall not be responsible for any damages or losses resulting from viruses, malware, or other harmful components transmitted through Getz Healthcare E-Store or any third-party websites linked to or from the E-Store.
Regarding goods or services purchased through this site, the liability of Getz Healthcare and its affiliated companies is expressly limited to the replacement of defective goods or, at our discretion, the repayment or crediting of the buyer with an amount equal to the purchase price of the goods. You acknowledge and agree that these limitations mentioned above are fundamental elements of this agreement, and without them, the site would not be provided to you. The user's other remedy in such cases is to discontinue the use of the site.
Price and Payment
Getz Healthcare reserve the rights to change the prices and delivery costs from time to time at our discretion.
Except in cases of obvious error. Please note that images of the products are for illustration purposes only.
While we make every effort to ensure the accuracy of pricing information on the E-Store, it is possible that some products may be incorrectly priced despite our best efforts. In such cases, we will rectify any errors as soon as possible upon becoming aware of them. If a product's correct price is different from the price stated on the E-Store, we will, at our discretion, either contact you for instructions before dispatching the product, or reject your order and notify you of the rejection.
Payment for the products shall be made through credit teems or other acceptable payment methods as determined by us. The E-store will provide the necessary instructions and secure payment processing mechanisms to complete the transactions.
Cancellation, Returns and Refund Policy
All orders are subject to our acceptance, verification, and the availability of the products. We reserve the right to refuse or cancel any order for any reason, including but not limited to limitations on quantities available for purchase, inaccuracies in product or pricing information, or suspicion of fraudulent activity. In such cases, we will notify you of the cancellation and refund any payment you have made. Refunds will be processed in accordance with the terms of your credit account with Getz Healthcare and / or if it is paid from Credit Card, the processing time for the refund will depend on your financial institution and we shall not be liable for any loss, damage, cost, or expense incurred as a result of any delay in your financial institution processing the refund.
For the following reasons, an exchange or refund of the product may be arranged:
- If the product is visibly expired or damaged upon the time of delivery, and / or;
- If the product is found to be expired or damaged inside the packaging after delivery, and you will need to contact us within 7 days from delivery, and / or;
- If the product you received is different from the item you ordered.
Modifications to the E-Store
Getz Healthcare may, at its discretion, make improvements or changes to the information, services, products, and other materials available on the Getz Healthcare E-Store, or terminate the E-Store, without prior notice. Getz Healthcare also reserves the right to modify this agreement at any time, and such modifications will be effective immediately upon posting of the updated agreement. Therefore, it is your responsibility to review the agreement periodically, and your continued access or use of the E-Store will be considered as your acceptance of the modified agreement.
Privacy and Data Protection
At Getz Healthcare, we value and prioritize the protection of your privacy and the confidentiality, security, and safeguarding of all personal data you share with us for legitimate purposes. We are committed to ensuring that any personal data you provide via the E-Store or the app is processed in compliance with relevant data protection laws. We encourage you to familiarize yourself with our Data Privacy Policy, which outlines our practices regarding the collection, usage, and processing of your personal data.
Governing Law and Jurisdiction
This agreement and the resolution of any dispute related to this Agreement, or the site shall be governed by and construed in accordance with the laws the Hong Kong Special Administrative Region of the People’s Republic of China (“Hong Kong”), without giving effect to any principles of conflicts of law. Getz Healthcare’s failure to insist upon strict enforcement of any provision of this agreement shall not be construed as a waiver of any provision or right. Any legal action or proceeding between Getz Healthcare and you related to this agreement shall be brought exclusively in a court of competent jurisdiction.

General/ownership
Unless expressly stated otherwise, the content included on the Site, including, but not limited to text, software, photographs, graphics, images, artwork, illustrations, video, sound, music, names, logos, trademarks and service marks, are the property of Getz Healthcare or its licensors or suppliers. This content is protected by copyright, trademark and other laws. No right, title, or interest to the content is granted by your use of the Site, other than a right to review the content using a standard Internet browser to conduct customary web browsing. All other uses, including making copies of any content on the Site, are strictly prohibited. Except for non-commercial individual private use, the downloading, retransmission, or reproduction of the Site (or any part of its content) is strictly prohibited. You may not modify, reproduce, distribute, retransmit, disseminate, sell, publish, circulate or broadcast any material for any purpose other than personal and commercial use without express written consent from Getz Healthcare.
Severability
The provisions of the Terms and Conditions shall be enforceable independently of each other and the validity of each provision shall not be affected if any of the others is invalid. In the event that any provision or any part of a provision of the Terms and Conditions is determined to be or becomes illegal, invalid or unenforceable, the validity and enforceability of the remaining provisions or remaining part of the provision of the Terms and Conditions shall not be affected and, in lieu of such illegal, invalid, or unenforceable provision or part of a provision, there shall be added as part of the Terms and Conditions one or more provisions as similar in terms as may be legal, valid and enforceable under the applicable law.
Entire Agreement
The Terms and Conditions shall constitute the entire agreement between user and Getz Healthcare relating to his/her/its use of the Site, and shall replace and supersede all other communications (be it written or oral), discussions, letters and contracts relating to the subject matters hereof.
